Ivy Matsepe-Casaburri, minister of communications, has lauched a court action to stop ICASA (Independent Communications Authority of South Africa) from issuing Altech Autopage with a licence that will allow it to self-provide.
According to a report today on Fin24.com, the minister has lauched an urgent interdict to prevent ICASA from complying with an earlier high court judgement giving Altech and other VANS the right to build their own networks.
The minister has applied for leave to appeal that judgement, although ICASA has decided not to.
While the minister awaits the outcome of her application to appeal, Altech has demanded that ICASA hand over its I-ECNS licence as laid down by the court.
Since ICASA isn't trying to appeal, not issuing the licence would place it in contempt of court – unless the minister succeeds with her interdict this week.
