The appointee should:

  • Have a Degree in Law.
  • Have at least 3 – 5 years’ experience to a leadership role in the mining industry, of which 7 should be at a management level.
  • Be an admitted attorney or advocate.
  • Demonstrate good understanding of the relevant Mining Legislation.
  • Be able to draft and execute applications for environmental authorization in terms of the National Environmental Management Act (NEMA), the processes thereunder, including the requirements of public participation.
  • Be able to draft and execute applications for water use licences in terms of the National Water Act of 2008 (NWA).
  • Be able to draft and execute applications for waste management licenses in terms of the National Environmental Waste Management Act of 2008 (NEMWA) for the creation of stockpiles (tailings or waste dams).
  • Attend to the integration of required licensing and other processes and procedures under the MPRDA, NEMA, NEMWA, etc. for purposes of obtaining and retaining mineral right tenure.
  • Assist with drafting and implementation of social and labour plans required in terms of the regulations to the MPRDA and their implementation.
  • Assist with Mineral rights applications, including applications for and renewals and amendment of mining rights and prospecting rights to the DMR.
  • Assist with Section 102 applications to the DMRE for amendment of mineral rights.
  • Demonstrate basic understanding of Protection of Personal Information Act (POPI).
  • Apply the organisation’s code of conduct in a work environment.
  • Demonstrate knowledge and application of ethical conduct in a business environment.
  • Describe and assist in the control of fraud in an office environment.
  • Apply principles of risk management.
  • Demonstrate understanding of Alternative Dispute Resolution mechanisms/processes and best practice.
  • Be declared medically fit for the position and environment, as determined by a risk based medical examination at the relevant Sibanye Stillwater Occupational Health Centre.

Advantageous requirements:

  • Post Graduate Degree Environmental Law.

Key responsibilities include:

  • Identify and interpret related legislation and its impact on the business and ensure compliance.
  • Develop the organisations codes of practice.
  • Implement codes of conduct in the team, department or division as necessary.
  • Ensure adherence with the organisation’s code of conduct, corporate governance and ethics guidelines.
  • Ensure compliance with legal requirements (sub-contractors, service providers, etc.).
  • Manage and mitigate business risks and contribute to the management of legal risk.
  • Maintain and update a legal risk register.
  • Notify line management, employees and relevant stakeholders on current developments or changes to legislation.
  • Ensure line management complies with all business related legislation and addresses non-conformances.
  • Provide written and verbal legal opinions to the organisation, as required.
  • Represent the organisation at Joint Forum meetings at industry bodies and at the Minerals Council of South Africa meetings.
  • Draft and review all legal agreements in terms of the mandate and make suitable recommendations.
  • Interpret and manage conflicts within the organisation.
  • Assist in developing the Internal Disciplinary Code mechanisms and procedure for the organisation.
  • Manage internal Disciplinary processes if required.
  • Consolidate information for the Company Annual Report.
  • Manage conflicts within the Unit.
  • Identify training needs and develop, maintain and update training programmes as necessary.
  • Drive a culture of Learning and Continuous Improvement within the organisation.
