Our client offers integrated solutions for corporate clients both in South Africa and across the African continent by providing tailored solutions to targeted corporates. They specialise in retirement fund administration to institutional retirement funds spread over a number of industries and services from large single employer run stand-alone funds to multi-employer umbrella funds. This business unit is also responsible for ongoing client servicing ranging from board of Trustees, Employers, Intermediaries and Employees. It is also responsible for the IT deliverables and digital strategy for Employee Benefits. The role provides many opportunities for growth and development.

Responsibilities:

  • Provide leadership to the legal team and ensure that the team functions effectively;
  • Allocate requests for legal opinions to a legal adviser and consult with the adviser where required;
  • Provide accurate and timely legal advice on matters relating mainly to pensions law and insurance law which affects the business unit;
  • Interpret existing legislation and regulatory instruments (“legislation”) and the impact thereof on the business and its clients;
  • Assist in providing comments via industry bodies on draft or proposed new/amended legislation with a view to ensure, as far as possible, that such legislation will be unambiguous and fair towards their clients;
  • Inform business unit of any new/amended legislation that may affect the business and provide guidance on the implications thereof for, and actions to be taken by, the business;
  • Provide regular reports on regulatory developments in the employee benefits industry;
  • Draft or vet non-standard contracts where business unit is involved, and ensure that the terms thereof are reasonable and that company interests are duly protected;
  • Assist with analysing and resolution of disputes, and manage litigation, where business unit is involved;
  • Represent the business unit at stakeholder engagements or industry bodies, if required.

Qualification and experience required:

  • LLB or higher degree
  • Registered Attorney with 8 to 10 years related experience.
  • At least 8-10 years’ experience in pensions law and insurance law (experience in the law relating to group life insurance will be an advantage);
  • Sound knowledge of South African law;
  • In-depth knowledge of Pension Funds Act, provisions of Income Tax Act relating to retirement funds and relevant insurance legislation, as well as a sound knowledge of other laws affecting retirement fund administrators, retirement funds, financial services providers and insurers providing group life insurance.
